Terms of Service

These Terms of Service ("Terms") are a binding agreement between you (the "Customer", "you") and Berat Engin Büyükada, trading as Conformly ("we", "us", "our"). They govern your access to and use of the Conformly website at https://getconformly.com and the Conformly application (together, the "Service").

By creating an account, placing an order, or using the Service, you confirm that you accept these Terms and that you have authority to accept them on behalf of the organisation you represent. If you do not accept them, do not use the Service.

1. Who we are

The Service is operated by:

2. The Service

Conformly is a business-to-business software service that helps organisations prepare for and maintain compliance with Regulation (EU) 2024/1689 (the "EU AI Act") and related frameworks. Depending on your plan, the Service may include:

  • a deterministic risk classifier for AI systems;
  • an automatically generated breakdown of the obligations that apply to a classified system;
  • obligation tracking, an evidence vault and policy templates;
  • Annex IV technical documentation starters and audit-ready report exports;
  • regulation change alerts and framework mappings.

The Service is intended for professional and business use only. It is not offered to consumers, and it is not intended for use by anyone under 18.

3. Automated guidance — not legal advice

This clause is important. Please read it carefully.

Conformly produces automated guidance, not legal advice. We are not a law firm, we are not your lawyer, and no lawyer–client relationship is created by your use of the Service.

  • Classifications, obligation lists, policy templates, reports and any other output are generated by software from the information you provide. They are informational aids to your own compliance work.
  • Output may be incomplete, may not reflect the most recent regulatory guidance or national implementing measures, and may not fit the specific facts of your organisation.
  • You remain solely responsible for your regulatory compliance, for the accuracy of the information you supply, and for any decision you make. Before you rely on any output for a regulatory filing, an audit, a contract or any other consequential purpose, have it reviewed by a qualified legal professional in the relevant jurisdiction.
  • Using the Service does not guarantee compliance with the EU AI Act or any other law, and does not protect you from enforcement action, fines or third-party claims.

4. Accounts

You must provide accurate account information and keep it up to date. You are responsible for all activity under your account and for the confidentiality of your credentials. You must tell us promptly at support@getconformly.com if you suspect unauthorised access.

Accounts are for your organisation. You may invite team members within the limits of your plan. You may not share a single set of credentials among multiple people, or sell, resell or lease access to the Service.

5. Acceptable use

You agree not to:

  • use the Service unlawfully, or in breach of any regulation, sanction or third-party right;
  • upload content you have no right to upload, or personal data you have no lawful basis to share with us;
  • upload malware, or attempt to gain unauthorised access to the Service, other customers' data, or our infrastructure;
  • probe, scan, load-test or penetration-test the Service without our prior written consent;
  • scrape, crawl or bulk-extract the Service, or use it to build or train a competing product;
  • misrepresent the Service's output as legal advice, certification or approval by us or by any authority;
  • remove, obscure or alter any disclaimer, attribution or notice in the Service or its output.

We may suspend access immediately where use threatens the security, integrity or availability of the Service.

6. Plans, billing and Paddle as merchant of record

Our plans and prices are published at https://getconformly.com/pricing. At the date of these Terms they are: a one-time Compliance Report at $390; Starter at $1,490/year; Growth at $4,990/year (or $490/month); and Enterprise from $9,900, quoted individually.

Our order process is conducted by our online reseller Paddle.com Market Ltd. Paddle.com Market Ltd is the Merchant of Record for all our orders. This means that when you buy a plan or a one-time report:

  • Paddle.com Market Ltd — not Berat Engin Büyükada — is the seller of record for that transaction;
  • Paddle processes the payment, collects and remits any applicable sales tax, VAT or GST, and issues your invoice or receipt;
  • Paddle's own Buyer Terms and Conditions apply to the purchase transaction, alongside these Terms which govern your use of the Service;
  • refunds, chargebacks and billing corrections are executed by Paddle, in line with our Refund Policy;
  • we never receive or store your card details. Payment card data is handled entirely by Paddle and its payment processors.

Subscriptions renew automatically for a further term at the then-current locked price unless cancelled before the renewal date. Prices are stated exclusive of tax unless shown otherwise at checkout; tax is calculated by Paddle based on your billing location. If a payment fails, we may retry it and may suspend paid features until the balance is settled.

7. Price-lock guarantee

The price you sign up at is locked for as long as your subscription remains continuously active: we will not raise your renewal price. If you cancel and later resubscribe, or change to a different plan, the then-current published price for that plan applies (and is then locked in turn). The guarantee covers the subscription fee only — it does not cover taxes, currency conversion, or charges set by Paddle or your bank.

8. Your data and your content

You retain all rights in the data, documents and evidence you upload ("Customer Content"). You grant us a limited, worldwide, non-exclusive licence to host, process and display Customer Content strictly for the purpose of operating and supporting the Service for you.

We may generate aggregated, de-identified statistics about how the Service is used to improve it. Such statistics never identify you, your organisation or your Customer Content. We do not sell Customer Content, and we do not use it to train third-party AI models.

How we handle personal data is described in our Privacy Policy.

9. Intellectual property

The Service — including the software, classification logic, obligation library, templates, content, design and the Conformly name and logo — is owned by Berat Engin Büyükada or its licensors and is protected by intellectual property law. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your organisation's internal business purposes for the duration of your subscription.

Reports and documents the Service generates for you from your inputs are yours to use, keep and share within and outside your organisation for your own compliance purposes. The underlying templates and the Service itself remain ours.

You may not copy, modify, reverse-engineer, decompile or create derivative works of the Service except to the extent that restriction is prohibited by applicable law.

10. Availability and support

We aim to keep the Service available and to fix faults promptly, but we do not promise uninterrupted or error-free operation unless a specific service level is agreed in writing (Enterprise). We may carry out maintenance, and may change, improve or discontinue features. Where a change materially reduces core functionality of a paid plan, we will give reasonable notice.

Support is provided by email at support@getconformly.com and through our self-service help centre and guides. Response targets depend on your plan.

11. Warranties and disclaimers

To the maximum extent permitted by law, the Service and all output are provided "as is" and "as available", and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service's output is accurate, complete, current or sufficient for regulatory compliance.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

12. Limitation of liability

To the maximum extent permitted by law:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, data, anticipated savings, or for regulatory fines or penalties imposed on you, however caused;
  • our total aggregate liability arising out of or in connection with these Terms and the Service, whether in contract, tort (including negligence) or otherwise, is limited to the total amount you actually paid for the Service in the twelve (12) months immediately before the event giving rise to the claim.

You accept that this allocation of risk is reasonable, and reflects both the price of the Service and the fact that the Service provides automated guidance which you are responsible for reviewing (clause 3).

13. Indemnity

You will indemnify and hold harmless Berat Engin Büyükada against claims, losses and reasonable costs arising from your Customer Content, your use of the Service in breach of these Terms or applicable law, or your presentation of Service output as legal advice or certification.

14. Suspension and termination

You may cancel your subscription at any time; cancellation takes effect at the end of the current paid term, as set out in the Refund Policy.

We may suspend or terminate your access if you materially breach these Terms and, where the breach is capable of remedy, do not remedy it within 14 days of notice; if payment remains unpaid after a reasonable retry period; or if we must do so to comply with the law.

On termination your right to use the Service ends. You may export your data before the end of your term; afterwards, we delete or anonymise it in line with the retention rules in the Privacy Policy. Clauses that by their nature should survive (including 8, 9, 11, 12, 13 and 16) survive termination.

15. Changes to these Terms

We may update these Terms to reflect changes to the Service, to our operations or to the law. We will post the updated version here and change the "Last updated" date. Where a change is material and adverse to you, we will give reasonable advance notice by email or in-app before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not accept them, you may cancel.

16. Governing law and disputes

These Terms and any dispute arising out of them are governed by the laws of Türkiye, and the courts of Türkiye have exclusive jurisdiction, without prejudice to any mandatory statutory protection available to you.

17. General

These Terms, together with the Privacy Policy and Refund Policy (and any Enterprise order form), are the entire agreement between us on their subject matter. If a provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger or sale of assets. Nothing in these Terms creates a partnership, agency or employment relationship.
